AUTO AND PROPERTY DAMAGE SUBROGATION
We routinely assist insurance carriers and self-insureds to identify and pursue responsible third parties to recover amounts paid for claims to or on behalf of their insureds. Property damage litigation, as well as additional personal injury protection (APIP) subrogation and covered vs. non-covered scenarios, can result in significant recoveries. Occasionally, litigants obtain judgments in one state, only to discover that the assets available for enforcement are located in the State of New York. In these instances, we work with out of state judgment creditors to domesticate their foreign/out of state judgments in the State of New York. Upon domestication, we utilize the New York Civil Practice Law and Rules to attempt to liquidate the judgment.
INSURANCE POLICY DEDUCTIBLE COLLECTION
We assist insurers as they attempt to recover deductibles owing from their insureds according to applicable underlying policy terms. Our firm’s experience in liquidating commercial collection claims is routinely utilized in attempting to recover these amounts from insureds who have received the benefit of the associated loss and/or expense payouts under their policies.
